5.3. The prices displayed in the online shop and shown in the order are stated in euros (EUR) and include VAT.

5.4. The Buyer may pay for the goods using one of the following methods.

5.4.2. Bank transfer. The Buyer pays in advance by printing the order and transferring the payment to the online shop’s bank account at a bank branch.

5.5. The Buyer undertakes to pay for the goods without delay. The Seller begins preparing the order for dispatch once payment is received. The delivery period also begins at that point.

    6. Delivery
6.1. When selecting delivery at checkout, the Buyer undertakes to provide accurate delivery details.

6.2. The Buyer undertakes to accept the goods in person. If the Buyer is unable to accept the goods in person and they are delivered to the address provided, the Buyer may not make a claim against the Seller on the grounds that the goods were delivered to the wrong person.

6.3. The goods are delivered by the Seller or by a courier authorised by the Seller.

6.4. The Seller delivers the goods within the time frames stated in the product descriptions. These time frames are estimates and do not apply if the goods are out of stock and the Buyer has been informed of this. In exceptional circumstances, delivery may be delayed due to unforeseen events beyond the Seller’s control. In that case, the Seller will contact the Buyer without delay to agree on the delivery arrangements.

6.5. The Seller is not liable for failure to meet a delivery deadline if the goods are not delivered, or are delivered late, due to the Buyer’s fault or circumstances beyond the Seller’s control.

6.6. The Buyer must notify the Seller without delay if a parcel arrives in crushed or otherwise damaged packaging, contains goods that were not ordered, contains an incorrect quantity or is missing parts.

6.7. If the Buyer notices damage to the packaging at the time of delivery, they must note it on the courier’s delivery document or draw up a separate report in the courier’s presence. If the Buyer fails to record the packaging damage, the Seller is released from liability to the Buyer for damage to the goods resulting from that unrecorded packaging damage.

    7. Product quality and guarantees
7.1. Information about each product sold through the online shop is provided in its product description.

7.2. The Seller is not responsible for differences between the colour, shape, apparent size or other characteristics of the goods as displayed in the online shop and those of the actual goods where those differences are due to the Buyer’s display.

7.3. The Seller provides a guarantee of limited duration for certain goods. The duration and other terms of the guarantee are stated in the relevant product description.

7.4. If the Seller does not provide a guarantee for a particular type of goods, the statutory guarantee under applicable law applies.

    8. Returns and exchanges
8.1. If the Seller delivers goods that are defective or do not match the order, a Buyer who is a consumer may contact the Seller at info@gurmans.eu. In accordance with the Civil Code of the Republic of Lithuania, the consumer may request that the goods be repaired or replaced free of charge or, in the cases provided for by law, that the price be reduced proportionately or that the contract be terminated and the consumer receive a refund.
8.2. Withdrawal from a distance contract and return of goods
A Buyer who is a consumer has the right to withdraw from a distance sales contract within 14 calendar days of receiving the goods, without giving any reason, except in the cases set out in Article 6.228¹⁰(2) of the Civil Code of the Republic of Lithuania. If goods ordered in a single order are delivered separately, the withdrawal period begins on the day the last item is received. If an item is delivered in parts, the withdrawal period begins on the day the last part is received.

To exercise the right of withdrawal, the consumer may email an unequivocal statement of their decision to withdraw or the completed model withdrawal form below to info@gurmans.eu before the withdrawal period expires. Use of the model form is optional.

The consumer must send or hand back the goods to the Seller within 14 calendar days of giving notice of withdrawal, unless the Seller has offered to collect the goods. The deadline is met if the consumer sends the goods before the period expires. The consumer bears the direct cost of returning the goods if the Seller informed them of this obligation before the contract was concluded and did not agree to cover that cost. In all other cases, the Seller bears the cost.

The Seller will reimburse all payments received from the consumer, including any delivery charges paid, without undue delay and within 14 calendar days of receiving notice of withdrawal. If the consumer chose a more expensive delivery method, the Seller is required to refund delivery charges only up to the cost of the least expensive standard delivery method it offered. The Seller may withhold reimbursement until it receives the goods or the consumer supplies evidence of having sent them back, whichever occurs first. This does not apply if the Seller has offered to collect the goods. The Seller will use the same means of payment as the consumer used for the original transaction unless the consumer expressly agrees to a different method and incurs no additional fees as a result.

The consumer is liable for any diminished value of the goods only to the extent that it results from handling beyond what is necessary to establish their nature, characteristics and functioning. If the Seller fails to provide the required information about the right of withdrawal, the consumer is not liable for any diminished value, and the withdrawal period expires 12 months after the end of the original 14-day period. If the Seller provides that information during those 12 months, the consumer may withdraw from the contract within 14 calendar days of receiving it.

The consumer is liable for any diminished value resulting from handling beyond what is necessary for that purpose if the Seller provided the required information about the right of withdrawal before the contract was concluded.

Please pack the goods securely to protect them from damage in transit. If the original packaging is unavailable, other suitable packaging may be used. If you have the order number, please include it to help the Seller identify the order. The statutory exceptions referred to in clause 8.2 apply.

8.4. Where the consumer validly withdraws from a distance contract, a reduction in the value of the goods does not in itself entitle the Seller to refuse the return. The Seller may seek compensation for diminished value only under the conditions set out in clause 8.3.

8.5. If the goods delivered are defective or do not match the order, the consumer and the Seller will agree on how the goods are to be made available for repair or replacement. 8.6. A consumer entitled to terminate the sales contract due to defects in the goods must notify the Seller of their decision and return the goods at the Seller’s expense. The Seller will refund the price paid for the goods within 14 calendar days of receiving the goods or evidence that they have been sent back, whichever occurs first.

    9. Liability of the Buyer and the Seller
9.1. The Buyer is responsible for the accuracy of the personal data they provide. If the Buyer provides inaccurate data in the registration form, the Seller is not liable for the resulting consequences and may claim compensation for any direct losses incurred.

9.2. The Buyer is responsible for actions taken when using the online shop.

9.3. A registered Buyer is responsible for disclosing their login details to third parties. If a third party accesses the online shop using the Buyer’s login details and uses its services, the Seller will treat that person as the Buyer.

9.4. The Seller is released from liability for losses resulting from the Buyer’s failure to review these Terms where the Buyer had an opportunity to do so but failed to follow the Seller’s recommendations or comply with their obligations.

9.5. If the online shop contains links to third-party websites, the Seller is not responsible for the information or activities on those websites. The Seller does not supervise or control those websites or represent their operators.

9.6. If either party suffers loss or damage, the party at fault must compensate the other party for its direct losses.

    10. Marketing and communications
10.1. The Seller may run promotions in the online shop at its discretion.

10.2. The Seller may unilaterally change the terms of a promotion or cancel it without prior notice. Any change or cancellation takes effect from the time it is made.

10.3. The Seller sends all communications using the contact details provided in the Buyer’s registration form.

10.4. The Buyer may send notices and enquiries to the Seller using the telephone numbers and email addresses listed in the “Contacts” section of the online shop.

10.5. The Seller is not liable if the Buyer fails to receive information or confirmation messages due to disruptions in internet connectivity or in an email service provider’s network.

    11. Final provisions
11.1. These Terms are drawn up in accordance with the laws and regulations of the Republic of Lithuania.

11.2. Consumer dispute resolution. A consumer who believes that the Seller has infringed their rights or legitimate interests must first contact the Seller in writing at info@gurmans.eu and state their claim. The Seller will provide a written response giving reasons for its decision within 14 calendar days of receiving the claim.

If the Seller rejects the claim, upholds it only in part or fails to respond within 14 calendar days, the consumer may refer the dispute for out-of-court resolution to the State Consumer Rights Protection Authority, A. Goštauto g. 12, LT-01108 Vilnius, Lithuania, www.vvtat.lt. The consumer may also submit a request online through the Consumer Rights Information System at www.vtis.lt. The consumer also has the right to bring the matter before a court.
